1. Who you are contracting with
These Terms govern your access to and use of the website, courses, downloadable resources, community, and other services (collectively, the "Service") operated by Spicy Behavioral Consulting, trading as "Spicy Behavioral Institute™" ("we", "us", or "our"). By creating an account, purchasing a product, or otherwise using the Service, you agree to these Terms.
2. Eligibility and account
You must be at least 18 years old, or the age of majority in your jurisdiction. If you are using the Service on behalf of an organization, you represent that you have authority to bind it. You are responsible for safeguarding your login credentials and for all activity under your account, and you agree to provide accurate information and keep it current.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful, fraudulent, harassing, or harmful purpose.
- Infringe anyone's intellectual property, privacy, or other rights.
- Upload malware, probe, scan, or interfere with the security or integrity of the Service.
- Scrape, mirror, or systematically extract content except through features we provide.
- Resell, sublicense, or redistribute course content, downloads, or community materials.
- Reverse engineer, decompile, or attempt to derive source code from the Service.
- Circumvent paywalls, access controls, or technical limits.
4. Intellectual property
All content, courses, software, branding, documentation, and downloadable resources are owned by Spicy Behavioral Consulting or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to access and use purchased materials for your own personal or internal professional use, within the plan or product you have purchased. No other rights are granted.
5. User content
You retain ownership of content you submit (e.g., community posts, reflections, inquiries). You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely to operate and improve the Service. You are responsible for the content you submit and represent you have the rights to submit it.
6. Payments, subscriptions, and taxes
Payments are processed by our payment providers (Stripe). By placing an order you also agree to the payment provider's terms governing payment, billing frequency, currency, and authorization. We are responsible for fulfilling your order; the provider is responsible for the payment transaction itself.
One-time purchases are charged at the time of order. Subscriptions, where offered, renew automatically at the stated cadence until cancelled. You may cancel a subscription at any time by contacting us; access continues through the end of the paid period.

8. Service availability
We work to keep the Service available, but we do not warrant that it will be uninterrupted, error-free, secure, or available at all times. We may modify, suspend, or discontinue features at any time.
9. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, abusive behavior in the community, or repeated or serious policy violations. You may stop using the Service at any time. On termination, your right to access the Service ends; previously downloaded digital products you have already saved remain on your device subject to the license in Section 4.
10. Disclaimers
The Service and all content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Course and resource content is for professional education; it is not individualized clinical, legal, medical, or financial advice and does not create a clinician–client relationship.
11. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or related to these Terms or the Service will not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim. We will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited under applicable law (e.g., fraud or personal injury caused by negligence).
12. Indemnity
You agree to indemnify and hold us harmless from claims, damages, and reasonable expenses arising from your user content, your misuse of the Service, or your breach of these Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State in which Spicy Behavioral Consulting is organized, without regard to conflict of laws principles. The state and federal courts located there have exclusive jurisdiction over any dispute, except where applicable consumer law gives you the right to bring proceedings in your local courts.
14. Changes
We may update these Terms from time to time. Material changes will be reflected on this page with a new "Last updated" date. Continued use after changes constitutes acceptance.
15. Force majeure
Neither party is liable for failure or delay caused by events beyond reasonable control.
16. Assignment
You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
